Yes. A private individual can receive a VAT refund when buying an investment apartment intended for rental. There's no need to set up a business — you only need to complete the formalities: apply for a tax ID (NIP), register as an active VAT payer (form VAT-R) before signing the developer contract, and after the purchase file a VAT-7 return and JPK-VAT.
The refund is made between 15 and 180 days from filing the VAT return for the period in which the refund claim was reported. The unit must be used for taxable activities, e.g. rental.
